State sovereignty

In the course of defending passage by the House of four Joint memorials, essentially telling the federal government to back off, some members unleashed the old rhetoric about "state sovereignty."  It's all well and good for state representatives to defend state powers, responsibilities and jurisdiction, while warning federal authorities to adhere to their jurisdictional boundaries, but let's avoid claims that are indefensible.

Point One: The people, not the states, are sovereign.  See the Preamble of the Constitution.  See, also, the Supreme Court's landmark ruling in 1819, in McCulloch v. Maryland.

Point Two: States have powers, and are not sovereign.

Point Three: States have powers, not rights.

Point Four:  The Tenth Amendment does not create state sovereignty, and it does not create states rights. It provides that the powers not granted by the Constitution to the federal government, and those not prohibited by the Constituition, are reserved to the states.

A little less confusion by state actors will result in a little less confusion among Idahoans.

David Adler is professor of political science at Idaho State University.

Politics is hardly a science, it's a tragicomedy thang.

The Tenth Amendment Movement

The Tenth Amendment Movement or state sovereignty is a conservative political party product issued to republican State legislators across the United States, these radical conservatives are filing resolutions declaring state sovereignty, just as they did the last time a Democrat won the White House. For example by late 1994 at least eight states had passed versions, with 20 states planning to introduce them in 1995. The state-sovereignty movement is also a part of the anti-government sentiment including the militia movement, those resolutions abruptly ceased in 1995, after McVeigh blew up the Alfred P. Murrah Federal Building in Oklahoma City, killing 168 people.

The federal-state balance has moved to the federal side, constitutional experts acknowledge that, but it is very old news. Certainly it is no truer today than when George W. Bush and the Republican congress were in power, there were no resolutions from any states filed. The claims of these resolutions are indefensible on constitutional grounds, as several constitutional experts have already indicated; they rest on untenable interpretations of the Constitution's text, structure, history, and proceed as though the Civil War had been won by the Confederacy.

Republicans all over the United States find themselves backed into an ideological and political corner; their dogma has brought our country and our economy to its knees, ruining their conservative beliefs and political party’s relevance in modern American society.

Idaho’s rouge anti-federalist legislators are wasting valuable legislative time spending Idaho’s tax dollars working to preserve the conservative republican political party’s relevance and opposition to our elected president. Idahoans beware these radical conservative legislators are not concerned about our Idaho families or our future; theses actions are all about conservative arrogance in our state and maintaining power, the citizens of Idaho deserve better.

I rest my case.

Dept. of Education usurps states powers

Where in the Constitution is the federal government given any responsibility for education?

So you want easily led morons causing unrest?

By that token, what power does the President have?

Get back to me on that one.

Oh, don't worry. He'll be ineffective too after breaking in.

?

I think the preamble pretty much covers that. I think if you want tranquility and to promote the general welfare, you want to include education as a duty of government, otherwise you are wasting your time. Ignorance is un-American.

I was unaware of that! Thanks, Joe!

Thank you Professor for the simple presentation.

Short and to the point.
They still won't get it; not best of the best, or even best of the rest.

Who is they? Are them they?

I am FOREIGNOREGONIAN!!! HEAR MY MIGHTY bunch of grumbles

In 2005 George Bush signed

In 2005 George Bush signed an agreement called the North American Agreement on Labor Cooperation. You can find it a Naalc.com. Verify it at USA.gov. This establishes a trinational group to regulate labor in the United States, Canada , and Mexico. If you type aging% in the search box it will show you an overview of the plans for the working people of this nation and the others. It is a part of NAFTA and it is not agreed upon by Congress, states, or anyone but the Presidents of the three nations. Any move to guarantee Buy America provisions in Obama's pork pile would violate this agreement as would agreements to E-verify the labor used in the stimulus package. Should an agreement be agreed to by these countries to regulate or limit firearms it would probably be agreed to by the Federal "leaders". Idaho's attempts to ensure state sovereignty and ensure our right to bear arms are clearly defined and defensible in any court of the Federal Government or trinational government that the Federal has abroggated their power too. Thank you Idaho legislature. The Idaho state senators and representatives voted against the stimulus package and tried to vote US protections into these programs, except Mike Crapo, who voted to table US worker protections and pass the bill without protection.

If I start a labor movement I want that puppy born.

a good article on the state sovereignty here:

Point 5

Points 1-4 are exactly why Idaho and 19 other states are doing this. Getting back to the original Articles of Confederation. Not that it will ever work or means much without a revolution.

A lot of kids didn't learn a thing about that period then...

We sucked as a government at first. They should screen for senile dementia.

Articles of Confederation??? Are you serious???

I'll bet you're one of those running around screaming about the Magna Carta too.

I blame your parents for letting you drop of school in the 1st grade.

I'd scream about the Magna Vox if it had 6V6's and 15" 3-ways.
